This Privacy Policy explains how Mindcast Media ("Mindcast Media", "we", "us" or "our") collects, uses, discloses and safeguards personal information when you visit this website or submit a brand inquiry or creator application. By using this site you agree to the practices described here. If you do not agree, please do not use the site or submit a form.
1. Who we are
Mindcast Media is an influencer marketing agency that connects brands with creators. For the purposes of data protection law we act as a "controller" (or "business" under California law) in respect of the personal information described in this policy. 2. Information we collect
We collect the following categories of personal information:
Information you give us: brand inquiry form
- Identifiers and professional details: full name, job title, company name, company website, email address.
- Commercial information: description of your product or service, industry, campaign goals, target platforms, preferred creator types and size, estimated budget, launch timeline, number of creators sought.
- Any free-text context, notes, preferences or exclusions you choose to provide.
Information you give us: creator application form
- Identifiers: full name, email address, country of residence.
- Audience and channel data: primary platform, public channel or profile link, follower count range, average views range.
- Content information: content niches, description of your content, whether you have a media kit.
- Commercial information: prior brand-deal experience and typical sponsorship rate range.
- Any free-text motivation or additional context you provide.
Information collected automatically
- Technical data such as IP address, browser type and version, device type, operating system, referring URL and pages viewed.
- Usage data such as time on page, scroll depth and interactions, collected in aggregate to improve the site.
Information stored on your device
Our forms auto-save your in-progress answers to your own browser's local storage so you do not lose work if you close the tab. That draft stays on your device and is not transmitted to us until you submit the form. You can clear it at any time by clearing your browser's site data. See our Cookie Policy for details.
We do not intentionally collect special categories of data (such as health, biometric, racial or ethnic origin, religious beliefs, precise geolocation, or government identifiers) and we ask that you do not submit such information through our forms.
3. How we use your information
- To review, assess and respond to brand inquiries and creator applications.
- To match brands with suitable creators and to prepare proposals, shortlists and campaign plans.
- To communicate with you about your submission, including by email or telephone.
- To negotiate, enter into and perform contracts with brands and creators.
- To maintain internal records of our roster, pipeline and campaign history.
- To operate, secure, debug and improve the website.
- To comply with legal, tax, accounting and regulatory obligations, and to establish, exercise or defend legal claims.
- To send you marketing communications where you have opted in or where permitted by law; you can opt out at any time.
4. Legal bases for processing (EEA/UK)
Where the GDPR or UK GDPR applies, we rely on: (a) performance of a contract or steps taken at your request before entering into a contract; (b) our legitimate interests in operating and growing an agency business, evaluating partners and securing our site, balanced against your rights; (c) your consent, where required, for example for non-essential cookies or marketing email; and (d) compliance with a legal obligation.
5. How we share information
We do not sell your personal information. We disclose it only as follows:
- Service providers acting on our instructions: website hosting, form and email delivery, cloud storage, customer relationship management, and analytics providers.
- Campaign counterparties: with your knowledge, we may share relevant brand brief details with creators we propose, and relevant creator channel and rate information with prospective brand clients, in order to evaluate a match.
- Professional advisers such as lawyers, accountants and insurers.
- Authorities or third parties where required by law, subpoena or court order, or to protect our rights, safety, or property.
- A successor entity in connection with a merger, acquisition, financing or sale of assets, subject to this policy.
6. International transfers
We are based in the United States and our service providers may process data in the United States and other countries. Where we transfer personal information out of the EEA or UK, we rely on appropriate safeguards such as the European Commission's Standard Contractual Clauses and, where relevant, the UK Addendum.
7. Retention
We keep submission data for as long as needed for the purposes above. In practice we retain unsuccessful brand inquiries and creator applications for up to 24 months so we can revisit a fit, and retain records relating to actual engagements for up to 7 years to meet contractual, tax and legal requirements. We then delete or anonymise the data.
8. Your rights
Depending on where you live, you may have the right to access, correct, delete, port or restrict the processing of your personal information, to object to processing based on legitimate interests, and to withdraw consent at any time. California residents have the right to know, delete, correct, and to opt out of "sale" or "sharing" of personal information and of targeted advertising; we do not sell or share personal information as those terms are defined, and we will not discriminate against you for exercising your rights. To make a request, email salahi@mindcastmediaco.com. We may need to verify your identity. You may also lodge a complaint with your local supervisory authority.
9. Security
We use reasonable administrative, technical and organisational measures, including encryption in transit, access controls and vendor due diligence, to protect personal information. No method of transmission or storage is completely secure, and we cannot guarantee absolute security.
10. Children
This site is intended for business users aged 18 and over. We do not knowingly collect personal information from children under 16. If you believe a child has provided us information, contact us and we will delete it.
11. Third-party links
Our site links to third-party services such as LinkedIn. We are not responsible for their privacy practices; please review their policies.
12. Changes
We may update this policy from time to time. We will revise the "last updated" date above and, where the change is material, provide additional notice.
